Research report
A research report is the sourced material a domain
dossier is synthesized from — generated on a plan and a cadence, one topic per file.
A report carries no confidence tags. Its bracketed markers say who might have
an incentive to shade a line; none of them says anyone checked it. To reach a score, a line has
to be drafted onto a candidate as unverified and pass the Verifier or the
Corroborator, like everything else.

Domain: cross-cutting · Scope: Settles the enforcement half of idea-002 REQ-0041 (claims 50 and 63). The statutory half — that 21 U.S.C. 351/352 carry no human-use qualifier where 21 CFR (Title 21 of the Code of Federal Regulations) 807.20(a)/807.81(a)/814.1(a) expressly do — was settled on 2026-09-13 by cross-cutting.fda-regulatory-posture.animal-device-premarket-exemption-cpg-655-100 and is not re-litigated here; it is cited by report_id, not re-sourced. This report covers only (a) FDA (US Food and Drug Administration)'s STATED posture — CPG Sec. 655.100, any successor or related compliance policy guide — and (b) FDA's EXERCISED posture — a named action with an identifier. fda.gov is a named out-of-scope-blocked host in this repo and was re-probed as HTTP 401 this pass by the invoking agent; no fda.gov page was fetched. Alternate hosts attempted: govinfo.gov, federalregister.gov (via this repo's `policy`/`policy-scan` connectors), hhs.gov Guidance Portal, api.fda.gov, ecfr.gov (via the `regulation` connector). Excludes CPT (Current Procedural Terminology) descriptors, licensed veterinary datasets, case-law databases (none exists in this repo's tool surface), and non-US/EU jurisdictions.
Sourcing: Rests entirely on federal registry records retrieved this pass — three eCFR sections via this repo's `regulation` connector, one Federal Register notice via govinfo, and three openFDA device/enforcement recall records. The stated half is a documented negative: CPG Sec. 655.100's own text was not retrieved from any reachable host, and nothing about its wording is asserted.
The two halves of this question resolve differently. FDA's stated posture stays undocumented: CPG Sec. 655.100's own text was not retrieved from any host reachable this pass, no successor or replacement compliance policy guide was retrieved either, and no line below quotes any CPG. FDA's exercised posture is documented, narrowly: three device recall records in FDA's Recall Enterprise System describe products labelled for veterinary use only, and FDA classified all three as Class II (FDA device class II) [5][6][7]. Because 21 CFR 7.3(g) defines a recall as a firm's removal or correction of a product "that the Food and Drug Administration considers to be in violation of the laws it administers and against which the agency would initiate legal action, e.g., seizure" [1], an FDA-classified recall of a veterinary-only-labelled device is an exercised agency act, not merely a private one. All three were nevertheless firm-initiated rather than FDA-requested [5][6][7], and no warning letter, seizure or FDA-requested recall against an animal-only device was located.
_Baseline (v1). No prior version; this establishes the starting point for future diffs._
No text of CPG Sec. 655.100 is quoted or characterised in this report. The policy-scan connector found no Federal Register document published 1996-09-27 to 2026-09-20 containing the exact phrase "Devices for Use in Animals" other than one 2010 omnibus guidance list whose full text the policy connector could not retrieve (HTTP 403). An FDA notice withdrawing CVM compliance policy guides in February 2020 was not found in the Federal Register: a scan of FDA documents published 2020-01-01 to 2020-12-31 matching "compliance policy guide" returned 29 records, none of them a CVM CPG withdrawal. The HHS Guidance Portal returned HTTP 403 on both its search endpoint and a direct document path. Search results describing the CPG's wording were read and are not treated as sources of record; see section 5.
The request pairs "CPG Sec. 655.100" with "CPG 7125.35". A Federal Register notice of 2006-07-07 states that FDA announced in the Federal Register of 1992-07-30 (57 FR 33729) "the availability of a revised CPG 7125.35 entitled 'Human-Labeled Drugs Distributed and Used in Animal Medicine'", that this CPG "explained how FDA would exercise its enforcement discretion with respect to the distribution and use of human-labeled drug products for use in animals", and that "FDA is withdrawing CPG 7125.35 because it is obsolete" [4]. The same notice records that "CPG section 615.100 entitled 'Extralabel Use of New Animal Drugs in Food-Producing Animals (CPG 7125.06)' was withdrawn" on 1998-09-24 (63 FR 51074) [4]. On this record, 7125.35 names a drug-distribution guide withdrawn in 2006, and the 7125.xx-to-6xx.xxx mapping it evidences is 7125.06 → 615.100. Whether 655.100 also carries a 7125.xx number is not established here.
openFDA's device/enforcement endpoint held 39,949 records as of its stated last update of 2026-09-09. Three carry "veterinary use only" in the product description:
21 CFR 7.3(f) puts a device "intended for human or animal use" inside the Part 7 definition of "Product", and 7.3(g) ties the word "recall" to a product FDA "considers to be in violation of the laws it administers" [1]. FDA's classification of each of the three as Class II is therefore an agency act on an animal-labelled device. It is not a compelled one: 21 CFR 7.40(a) states that "Recall is a voluntary action that takes place because manufacturers and distributors carry out their responsibility", 7.40(b) reserves an FDA request that a firm recall "for urgent situations", and 7.45 sets out the separate FDA-requested-recall mechanism [2][3]. All three records read "Voluntary: Firm initiated" [5][6][7], and a query combining voluntary_mandated:"FDA Mandated" with a veterinary product description returned no matching record.

Well established: Nothing here rests on two independent, non-affiliated organisations. Every source is a federal record — eCFR text, one Federal Register notice, three FDA recall records — so all of it is single-origin federal registry material rather than a multi-witness statement. No line carries a sourcing marker, because a registry quoting its own text is not directional and has no second witness to want; the openFDA recall records are FDA's transcription of what the recalling firm reported to it, and the product descriptions and recall reasons quoted at (b) are firm-supplied text inside a federal record, which is why (b2) is careful to say only what the classification act establishes.
Thin: The whole stated half. It is a negative, not a finding: section 3(a) reports non-retrieval and asserts nothing about CPG 655.100's content. Section 3(a2) rests on one Federal Register notice [4], which is authoritative for what it says about CPG 7125.35 and is not authoritative for anything about 655.100.
Rescoped from class 3: None. The manifest question asks what a named federal document states and what named actions exist in a federal database. Neither asks what a person would do. Note for a later reader: "FDA's posture" is a phrase that invites a class-3 answer about agency intent, and it was deliberately read here as two answerable questions — what a retrievable document states, and what a retrievable record shows FDA did.
Out of scope: All fda.gov pages, including the two CPG Sec. 655.100 URL paths, the Compliance Policy Guides manual Chapter 6 (Veterinary Medicine), the CPG Revision/Update History page, the "How FDA Regulates Animal Devices" page, the CVM Update announcing the February 2020 CPG withdrawals, and FDA's warning-letter and animal-and-veterinary recall databases. web.archive.org, which WebFetch refuses by design. Case law applying §§ 501/502 to an animal-only device — no case-law connector exists here.
Not searched vs. not found:
policy-scan; FR Doc 2010-19342 full text via policy (HTTP 403, "not read", never "not present"); govinfo.gov's HTML rendering of that document (the requested phrases were not present in what was returned, which may be a truncation of a very long document rather than their absence); hhs.gov Guidance Portal search and one direct document path (both HTTP 403); four WebSearch passes for a non-fda.gov mirror, which returned only fda.gov and hhs.gov URLs. Not fetched: fda.gov, per scope.
device/enforcement returned no record combining voluntary_mandated:"FDA Mandated" with a veterinary product description; the same query shape with "Voluntary" returned 19, confirming the syntax resolves rather than erroring. One WebSearch of DOJ press releases returned animal-drug and animal-feed actions only, and none was retrieved or cited.
Method note: This repo's recalls connector requires a product_code or firm selector and cannot take a free-text product-description term, so the three veterinary-labelled records were found by a filtered query against the same openFDA device/enforcement endpoint the connector calls. Z-1474-2024 was then re-retrieved through the connector on recalling_firm:"Karl Storz Endoscopy" and matched. Z-1640-2022 and Z-1911-2020 were not re-retrieved through the connector: firm-scoped windows returned 96 and 113 matches respectively against a 50-record cap, and the connector offers no narrower selector.
[inference] That an FDA Class II classification of a firm-initiated recall constitutes an exercised agency act on an animal-labelled device is my reading of 21 CFR 7.3(g) against the three recall records; no source states that conclusion. The observation that the request's "(CPG 7125.35)" parenthetical conflicts with FR Doc E6-10672 is also mine — the notice does not mention 655.100, and the conflict is flagged rather than resolved.
