CLIA regulation requires that "each laboratory that... introduces a test system not subject to FDA clearance or approval (including methods developed in-house)... must, before reporting patient test results, establish for each test system the performance specifications" for accuracy, precision, analytical sensitivity, analytical specificity, and reportable range [1]. That is a registry-level obligation, not a preference, and it is the regulatory floor that makes some reference material necessary — not necessarily a third-party commutable panel, which remains an open question the dossier already records as unresolved.

That is the closest published evidence located for the daily operator's actual capacity constraint — not whether an operator would prefer a reference-material product, but the workforce condition under which any daily QC procedure must run.

Downstream customer — the assay manufacturer (Natera, Guardant, and smaller entrants)

The regulatory floor the assay manufacturer must clear moved twice inside the citable window. FDA's May 2024 final rule stated that "through premarket review, the Agency evaluates the scientific information supporting the analytical validity, clinical validity, and safety of high- and moderate-risk IVDs," and extended that device framework to laboratory-developed tests, effective 2024-07-05 [6]. A district court vacated that rule, and FDA's September 2025 final rule implementing the vacatur reverted 21 CFR 809.3's device definition to its pre-2024 text, effective 2025-09-19 [7]. [5] is a single 70-laboratory survey with no molecular-specific vacancy rate broken out in the abstract [single-source].
